Oklahoma Law & Your Rights

Under 4 O.S. § 42.1, a dog owner is liable when their dog, without provocation, bites or injures a person who is in a place where that person has a lawful right to be. You do not have to prove the owner knew the dog was dangerous, and Oklahoma has no 'one free bite' rule in the areas the statute covers. Because lack of provocation and lawful presence are part of what an injured person must show, the owner will usually argue one of those points. A separate section, 4 O.S. § 42.3, provides that this rule does not apply in rural areas or in towns without city or village U.S. mail delivery; in those places a claim generally depends on common-law negligence or on the owner's knowledge that the dog was dangerous. The general deadline for a personal injury claim in Oklahoma is two years under 12 O.S. § 95, but different rules can apply, including for children, so confirm the deadline that fits your situation with a lawyer.
