What if the dog owner says I provoked the dog?

Lack of provocation is part of what an injured person must show under 4 O.S. § 42.1, so owners often raise it. Oklahoma does not define provocation in the statute, and whether it occurred is usually a fact question for the jury. Everyday conduct such as petting a dog, walking past it, making eye contact, or accidentally bumping it is generally not provocation, and a young child's behavior is judged with the child's age in mind.
